AI, Copyright, and Protecting Your Voice: What the Latest Court Decisions Mean for Creators

U.S. courts are finally drawing real boundaries around how AI systems can use copyrighted works — and the latest rulings show just how important it is for individuals to understand their rights.
A recent Reuters article covered series of decisions highlight two major themes:
1️⃣ Training AI on lawfully acquired data can be fair use, and
2️⃣ Pirated or improperly sourced data is a legal liability.
In Bartz v. Anthropic, the court ruled that using lawfully obtained books to train an LLM was fair use because the process is transformative — but the same court allowed infringement claims to proceed where pirated materials were retained internally, even if not actively used for training.
Another case, Kadrey v. Meta, reaffirmed that while AI training can be transformative, market harm remains the most important factor, and fair use is not automatic.
These cases underscore something I emphasize every day in my work with creators, artists, writers, and entrepreneurs.

Save drafts. Track your edits. Note where AI helped — and where it didn’t. The courts in 2025 made it clear: provenance and process matter more than ever.
🔹 Copyright registration is still your strongest shield
If your work is important to you — or your business — formal registration gives you standing, statutory damages, and a public record. In a world where AI can mimic styles or structures, this protection is strategic, not optional.
🔹 Fair use is evolving — fast
The same courts ruling on AI training emphasized:
Market harm is central.
Competing uses will almost always fail.
Even a potential licensing market can weigh against fair use.
For creators, that means AI companies aren’t the only ones who need to stay vigilant — you should too, especially when signing contracts that may quietly include AI‑training clauses.
My message to creators and businesses:
AI is powerful, but it does not replace your originality, your judgment, or your voice.
What protects you is knowledge — of your rights, your process, and your options.
If you’re building a creative career, running a business, or simply posting original content online, now is the time to:
✔ Document your contributions
✔ Understand how your work may be used
✔ Register key pieces
✔ Review licensing terms carefully
✔ Ask questions before signing anything involving AI
